Beta & Pre-Launch Status

The Platform is currently operated in a private beta and pre-launch testing phase and is not offered to the general public.

Access to the Services is limited to invited users, resellers, or partners participating in testing and evaluation activities.

The Services, features, pricing, policies, and legal structure are subject to change prior to public launch and formal commercial operation.

Pre-Incorporation Operation

Nash Sy Services is currently operated as a pre-incorporation project. References to "Nash Sy Services," "we," or "our" refer to the platform operator prior to formal incorporation.

The Services will be transitioned to a formally incorporated operating entity, at which time these Terms will be updated accordingly.

Notwithstanding its beta status, these Terms constitute a binding agreement governing participation in the beta phase.


1.0 SCOPE, ROLE, AND ACCEPTANCE

1.1 Scope of Application

These Terms of Service ("Terms") govern all access to and use of the website located at https://nashsy.com, including any associated subdomains, applications, application programming interfaces (APIs), payment interfaces, and related digital services (collectively, the "Platform" or "Services") operated by Nash Sy Services ("Nash Sy Services," "we," "us," or "our").

1.2 Role of Nash Sy Services as Intermediary

Nash Sy Services operates the Platform solely as an intermediary, facilitator, or agent connecting Users with third-party game publishers, developers, or authorized suppliers (collectively, "Suppliers") that provide the Digital Goods.

Nash Sy Services does not own, sell, resell, license, or distribute Digital Goods in its own name.

1.3 Acceptance of Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as any supplemental terms, policies, or guidelines referenced herein or made available through the Platform.

1.4 Legal Capacity and Authority

By using the Services, you represent and warrant that:

  • You are at least the minimum legal age required to enter into a binding contract in your jurisdiction;
  • You possess the legal capacity and authority to accept these Terms;
  • If you are using the Services on behalf of a legal entity, you have the authority to bind such entity to these Terms;
  • Your use of the Services complies with all applicable laws, regulations, and third-party agreements.

1.5 Amendments and Modifications

Nash Sy Services reserves the right, at its sole discretion, to amend, modify, or replace these Terms at any time, including to reflect changes in law, business practices, or risk management requirements.

2.0 DESCRIPTION AND USE OF THE SERVICES

2.1 Description of the Services

The Services provided through the Platform consist of a digital marketplace and facilitation system that enables Users to purchase Digital Goods supplied by third-party game publishers, developers, or authorized distributors ("Suppliers").

The Digital Goods offered through the Platform may include:

  • In-game currency top-ups;
  • Virtual items or credits;
  • Digital vouchers or prepaid codes;
  • Other publisher-authorized digital gaming products.

2.2 User Responsibility for Account and Game Information

You acknowledge and agree that the successful delivery of Digital Goods depends entirely on the accuracy of the information you provide at the time of purchase, including but not limited to:

  • Game User ID or account identifier;
  • Server, region, or shard selection;
  • Game-specific details required by the Supplier;
  • Selected product type and denomination.

Nash Sy Services shall not be liable for any loss, misdelivery, or failure caused by incorrect, incomplete, or inaccurate information provided by you.

2.3 Prohibited Uses

You agree that you shall not, directly or indirectly:

  • Use the Services for fraudulent, unlawful, or deceptive purposes;
  • Submit false, misleading, or unauthorized account information;
  • Attempt to manipulate pricing, promotions, or transaction flows;
  • Abuse refunds, chargebacks, or payment dispute mechanisms;
  • Circumvent or attempt to circumvent security measures or access controls;
  • Use automated systems, bots, or scripts without express authorization;
  • Use the Services in violation of any Supplier or game publisher terms of service.

3.0 TRANSACTIONS, PAYMENTS, AND PRICING

3.1 Transaction Structure

All transactions conducted through the Platform are facilitated by Nash Sy Services solely in its capacity as an intermediary or agent acting on behalf of third-party Suppliers.

3.2 Pricing and Fees

Prices displayed on the Platform are determined by Suppliers or are set in accordance with pricing frameworks provided by Suppliers.

Nash Sy Services may display prices inclusive of applicable fees, commissions, or service charges for transaction facilitation.

3.3 Payment Processing

Payments for Digital Goods are processed through third-party payment service providers ("Payment Processors").

By submitting a transaction, you authorize Nash Sy Services and its Payment Processors to process your payment on behalf of the applicable Supplier.

3.4 Chargebacks and Payment Disputes

You agree not to initiate chargebacks or payment disputes without first contacting Nash Sy Services customer support to seek resolution.

Unauthorized or abusive chargebacks may result in:

  • Suspension or termination of your account;
  • Restriction of access to the Services;
  • Referral of the matter for legal or collection action, where permitted by law.

4.0 USER ACCOUNTS, ACCESS, AND SECURITY

4.1 Account Registration

Certain features of the Platform may require you to create and maintain a user account ("Account").

When registering for an Account, you agree to provide accurate, complete, and current information as requested during the registration process.

4.2 Account Ownership and Control

Each Account is personal to the registered User and may not be sold, transferred, shared, or assigned to any other person or entity without Nash Sy Services's prior written consent.

You are solely responsible for all activity conducted through your Account, whether authorized or unauthorized.

4.3 Credentials and Security Obligations

You are responsible for maintaining the confidentiality and security of your Account credentials, including usernames, passwords, authentication tokens, or other access methods.

You agree to:

  • Use reasonable measures to safeguard your credentials;
  • Immediately notify Nash Sy Services of any suspected unauthorized access or security breach;
  • Ensure that your devices and networks used to access the Platform are secure.

4.4 Account Suspension and Termination

Nash Sy Services may, at its sole discretion, suspend or terminate your Account, temporarily or permanently, if Nash Sy Services determines that you have:

  • Violated these Terms or any Supplemental Terms;
  • Engaged in fraudulent, abusive, or unlawful conduct;
  • Abused payment, refund, or chargeback mechanisms;
  • Exposed Nash Sy Services or Suppliers to legal, financial, or reputational risk.

5.0 CREDITS, WALLET BALANCE, AND STORED VALUE

5.1 Credits Definition

"Credits" refers to a prepaid, stored-value balance that Users may purchase, deposit, or hold within their Nash Sy Services account for the purpose of facilitating transactions for Digital Goods through the Platform.

Credits are not legal tender, are not a bank deposit, do not earn interest, and have no intrinsic cash value outside the Platform, except as expressly provided under these Terms.

5.2 Deposits and Use of Credits

Users may deposit funds into their Account and convert such funds into Credits using supported payment methods.

Credits may only be used to purchase Digital Goods available through the Platform and may not be transferred, sold, gifted, or exchanged between Users unless expressly authorized.

5.3 Account Suspension or Termination

If a User's Account is suspended or terminated:

  • If the suspension or termination is due to fraud, abuse, chargeback activity, or unlawful conduct, Nash Sy Services reserves the right to withhold, offset, or forfeit all or part of the remaining Credits balance to the extent permitted by law;
  • If the suspension or termination occurs for reasons other than fraud or unlawful conduct, the User may request a refund of any unused Credits balance, subject to verification and applicable processing requirements.

6.0 USER CONDUCT AND PROHIBITED ACTIVITIES

6.1 General Conduct Obligations

You agree to use the Services in a lawful, responsible, and compliant manner and in accordance with these Terms, all applicable laws and regulations, and any applicable Supplier or game publisher terms.

6.2 Prohibited Activities

You shall not, directly or indirectly, engage in any of the following activities:

  • Fraud, attempted fraud, or deceptive practices;
  • Abuse of promotions, bonuses, discounts, or pricing errors;
  • Abuse of refunds, chargebacks, or payment disputes;
  • Use of stolen, unauthorized, or third-party payment methods;
  • Money laundering, terrorist financing, or other financial crimes;
  • Circumvention of security measures or access controls;
  • Exploitation of bugs, errors, or vulnerabilities in the Platform;
  • Submission of false claims, disputes, or complaints;
  • Violation of any Supplier or game publisher terms of service;
  • Use of the Services for any unlawful or prohibited purpose.

7.0 INTELLECTUAL PROPERTY RIGHTS

7.1 Ownership of Intellectual Property

All intellectual property rights associated with the Platform, including but not limited to software, source code, object code, databases, system architecture, user interfaces, designs, text, graphics, logos, trademarks, service marks, trade names, documentation, and other proprietary materials (collectively, the "Platform IP"), are owned by or licensed to Nash Sy Services.

7.2 Limited License to Users

Subject to your compliance with these Terms, Nash Sy Services grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Platform solely for personal, non-commercial use in connection with the Services.

7.3 Supplier and Third-Party Intellectual Property

All intellectual property rights relating to games, Digital Goods, trademarks, logos, characters, artwork, and publisher content are owned by their respective Suppliers, publishers, or licensors.

Nash Sy Services does not claim ownership over any Supplier or third-party intellectual property and displays such materials solely for identification, transactional, or informational purposes.

8.0 DATA PROTECTION AND PRIVACY

8.1 Collection and Use of Personal Data

In connection with the provision of the Services, Nash Sy Services may collect, process, store, and use personal data and other information relating to Users, including but not limited to account registration details, transaction records, payment information, device data, and communications.

All personal data is processed in accordance with Nash Sy Services's Privacy Policy, which forms an integral part of these Terms.

8.2 Purpose of Data Processing

Personal data may be processed for purposes including:

  • Facilitating transactions and delivery of Digital Goods;
  • Account management and customer support;
  • Payment processing and fraud prevention;
  • Compliance with legal, regulatory, and tax obligations;
  • Risk management and platform security;
  • Improving and optimizing the Services.

8.3 Data Security Measures

Nash Sy Services implements reasonable administrative, technical, and organizational measures designed to protect personal data against unauthorized access, disclosure, alteration, or destruction.

However, you acknowledge that no system is completely secure and that Nash Sy Services cannot guarantee absolute security of data transmitted or stored electronically.

9.0 LIMITATION OF LIABILITY

9.1 No Liability for Supplier or Third-Party Actions

You acknowledge and agree that Nash Sy Services acts solely as an intermediary and does not control the actions, systems, or performance of Suppliers, game publishers, Payment Processors, or other third parties.

To the fullest extent permitted by law, Nash Sy Services shall not be liable for any loss, damage, or harm arising from or related to:

  • Acts or omissions of Suppliers or game publishers;
  • Game account suspensions, bans, rollbacks, or restrictions imposed by publishers;
  • Errors, delays, or failures in Supplier or publisher systems;
  • Payment Processor outages or processing errors;
  • Third-party services or platforms linked to or integrated with the Services.

9.2 Disclaimer of Certain Damages

To the maximum extent permitted by applicable law, Nash Sy Services shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities;
  • Loss of data, goodwill, or reputation;
  • Game account losses or virtual item losses;
  • Service interruptions or downtime;
  • Emotional distress or personal dissatisfaction.

9.3 Indemnification

You agree to defend, indemnify, and hold harmless Nash Sy Services from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses arising out of or related to:

  • Your use or misuse of the Services;
  • Your violation of these Terms or any applicable law;
  • Your breach of any representation or warranty under these Terms;
  • Your violation of any Supplier or game publisher terms;
  • Any fraudulent, unlawful, or abusive conduct by you.

10.0 DISCLAIMER OF WARRANTIES

10.1 Services Provided "As Is" and "As Available"

The Services, Platform, and all Digital Goods made available through the Platform are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by applicable law, Nash Sy Services disclaims all warranties, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, or performance.

10.2 No Warranty as to Digital Goods or Supplier Services

Nash Sy Services does not warrant, guarantee, or represent that:

  • Digital Goods will meet your expectations or requirements;
  • Digital Goods will be uninterrupted, error-free, or permanently available;
  • Delivery of Digital Goods will occur within any specific timeframe;
  • Game publisher systems will remain operational or unchanged;
  • Any game account will not be suspended, banned, restricted, or modified by a publisher.

11.0 REFUND POLICY

11.1 General Refund Principles

Due to the nature of the Services and the Digital Goods facilitated through the Platform, all transactions are subject to this Refund Policy.

You acknowledge and agree that Digital Goods are intangible, electronically delivered products and, once successfully delivered or credited to a game account, cannot be returned, revoked, or exchanged.

11.2 No Refunds for Completed Digital Goods Transactions

Except where required by applicable law, all transactions for Digital Goods that have been successfully delivered or credited to the designated game account are final and non-refundable.

User dissatisfaction, change of mind, game balance changes, or publisher actions such as bans, rollbacks, or restrictions do not constitute grounds for a refund.

11.3 Eligible Refund Scenarios

Refunds may be considered only in the following limited circumstances:

  • Payment was successfully processed but Digital Goods were not delivered due to a verified technical error attributable to the Platform or Supplier;
  • A transaction was duplicated due to a system error;
  • Funds were deducted but the transaction failed to be submitted to the Supplier.

11.4 Non-Eligible Refund Scenarios

Refunds shall not be issued for transactions resulting from:

  • Incorrect game account, User ID, server, or region information provided by the User;
  • Violations of game publisher or Supplier terms of service;
  • Account suspensions, bans, or penalties imposed by publishers;
  • Delays or failures caused by Supplier, publisher, or Payment Processor systems;
  • Fraudulent or abusive activity;
  • Chargebacks initiated without prior contact with Nash Sy Services.

12.0 GOVERNING LAW AND DISPUTE RESOLUTION

12.1 Governing Law

These Terms, the Services, and any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or any transaction facilitated through the Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Nash Sy Services's operating entity is incorporated or primarily conducts business.

12.2 Good Faith Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute with Nash Sy Services in good faith by contacting Nash Sy Services's customer support or legal contact through the designated communication channels.

12.3 Class Action Waiver

To the fullest extent permitted by law, you agree that any disputes shall be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

13.0 RESELLERS, AFFILIATES, AND PARTNER PROGRAMS

13.1 General Partner Framework

Nash Sy Services may, at its sole discretion, offer participation in reseller, affiliate, or other partner programs ("Partner Programs") subject to these Terms and any supplemental partner-specific terms.

Participation in any Partner Program does not create an employment relationship, partnership, joint venture, franchise, or fiduciary relationship between Nash Sy Services and any Partner.

13.2 Resellers

Resellers are individuals or entities approved by Nash Sy Services to purchase Digital Goods through the Platform at discounted pricing for resale or onward distribution.

Resellers are required to maintain an active Account on the Platform and comply with all applicable Terms.

13.3 Affiliates and Content Creators

Affiliates are individuals or entities, including content creators, influencers, or media publishers, approved by Nash Sy Services to promote the Platform using unique referral links, tracking codes, or similar mechanisms ("Affiliate Links").

13.4 Prohibited Partner Conduct

Resellers and Affiliates shall not:

  • Engage in fraudulent, misleading, or deceptive marketing practices;
  • Use spam, automated traffic, or prohibited advertising methods;
  • Misrepresent pricing, discounts, or affiliation with Nash Sy Services;
  • Manipulate tracking systems or attribution mechanisms;
  • Violate applicable advertising, consumer protection, or disclosure laws.

14.0 GENERAL PROVISIONS

14.1 Entire Agreement

These Terms, together with any Supplemental Terms, policies, or guidelines expressly incorporated by reference (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and Nash Sy Services regarding your use of the Services.

14.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

14.3 No Waiver

The failure or delay of Nash Sy Services to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
